  10. The following terms and conditions apply to the Soccer Scorecard
  11. application.  Users must accept all of these conditions, or cease using
  12. the application immediately.

  14.  
  15. GENERAL (ALL VERSIONS)
  16. ======================
  17. * The authors shall maintain all proprietary and intellectual rights to
  18.   this application in perpetuity regardless of any other action.
  19.  
  20. * Soccer Scorecard is supplied as-is and without warranty, either
  21.   expressed or implied.  The sole exception is with regard to defective
  22.   media which shall be replaced free of charge providing the defective
  23.   goods are returned within 30 days of original shipment from the
  24.   authors.
  25.  
  26. * The user is responsible for ensuring the software meets their
  27.   individual needs and fitness for a particular purpose prior to
  28.   registration - as per the shareware concept.
  29.  
  30. * Once the registration fee is accepted and the user is provided with
  31.   the full set of registration benefits, this fee shall become
  32.   non-returnable.
  33.  
  34. * The authors shall not assume nor accept responsibility for any damage
  35.   or risk associated with the installation and/or use of this software,
  36.   howsoever caused and whether consequential or otherwise.
  37.  
  38. * All intellectual rights pertaining to Soccer Scorecard are owned by
  39.   and shall remain in the ownership of the authors, in perpetuity.  The
  40.   act of registration does not transfer these rights.
  41.  
  42. * All users of Soccer Scorecard shall at all times act in accordance
  43.   with the bona-fide interests of the authors, and shall indemnify the
  44.   authors against any associated costs, litigation, or other risks which
  45.   could be detrimental to the interests of the authors.
  46.  
  47. * The user understands and accepts that the authors of the application
  48.   have not set out to mislead the user, or misrepresent the capabilities
  49.   of the application.  In particular the user is required to accept that
  50.   the application has no guarantee whatsoever with regard to increasing
  51.   the chances of winning football pools competitions.

  53.  
  54. SHAREWARE VERSION
  55. =================
  56. * May be installed and used for evaluation purposes only for a
  57.   reasonable period of time which shall never exceed 30 (thirty) days
  58.   from first installation.
  59.  
  60. * On completion of the evaluation period (maximum 30 days from first
  61.   installation) the user/evaluator shall EITHER seek to register the
  62.   product with the authors by sending the required registration fee OR
  63.   cease using the product immediately and delete all copies of the
  64.   software from his/her computer equipment immediately.
  65.  
  66. * May be distributed to others and/or placed on publicly accessible
  67.   bulletin board systems (BBS).  It is however required that the entire
  68.   set of shareware files, as listed in FILELIST.TXT, are distributed
  69.   without change.  Additional files included with the distribution shall
  70.   be limited simply to one advertisement file relating to the BBS or
  71.   other distribution means.
  72.  
  73. * If Soccer Scorecard is provided in archive form (ZIP, LZH or other
  74.   proprietary archive methods) then the end user shall not be required
  75.   to pay a fee in order to access the contents of the archive.
  76.  
  77. * Distributors are not allowed to charge a fee for Soccer Scorecard.
  78.   However a reasonable administration, packaging and handling fee may be
  79.   acceptable PROVIDING that the distributor makes it clear that such
  80.   fees are not seen to be directly associated with the application
  81.   itself.  Users shall not be lead to believe they are making payment
  82.   for the software, or any contribution towards registration.
  83.  
  84. * For distribution purposes end-users must have a reasonable means of
  85.   access to these terms and conditions.  These terms and conditions
  86.   shall not be hidden or require specialised knowledge in order to
  87.   access.
  88.  
  89. * It is expressly forbidden for anyone to ship current season results
  90.   with the shareware version, or to otherwise make these available to
  91.   shareware users.
  92.  
  93. * In no event shall any claim or other litigation exceed the value of a
  94.   single registration fee.

  97. REGISTERED VERSION
  98. ==================
  99. * The authors maintain the right to refuse registration to anyone, even
  100.   if the required registration fee is provided.  Such registration fee
  101.   shall always be returned promptly in full in the event that
  102.   registration is refused.
  103.  
  104. * The registered version is licensed for use by an individual.  Only
  105.   that individual has the right to make use of the application.
  106.  
  107. * The registered version can never be distributed or made available to
  108.   others in any form whatsoever.
  109.  
  110. * User may make a reasonable number of backup copies of the registered
  111.   version, up to three maximum.  These backups shall not be made
  112.   available to others.
  113.  
  114. * The registration fee shall be accepted on the assumption that the user
  115.   is familiar with and accepts these terms and conditions in full.
  116.  
  117. * The act of registration, and acceptance thereof, shall provide the
  118.   user with the right to continue using the application (as supplied at
  119.   the time of registration) without further time limit.  No other rights
  120.   shall be transferred.
  121.  
  122. * Registration does not confer upon the user the belief that he/she
  123.   will receive future/enhanced versions of the application free of
  124.   charge. The authors may make available new versions which might be
  125.   shipped free to previously registered users - but this is not an
  126.   automatic entitlement and normally the authors would expect to
  127.   need to cover their costs at the very least.
  128.  
  129. * Registration is not transferrable, although the authors shall be
  130.   pleased to consider this based upon individual merits.
  131.  
  132. * Registration is revocable by the authors at any time in the event that
  133.   the user is deemed to be acting against the bona-fide interests of the
  134.   authors.  In the unlikely even this situation arises the registration
  135.   fee shall be non-returnable.
  136.  
  137. * Data files created and used by the application shall not be
  138.   distributed or made generally available to others by any means
  139.   whatsoever.
